Tracking Truth: a final report to the fan club’s membership from its national president

I was a lot smarter before I was recruited by the American Chapter of Truth’s International Fan Club. Until then, I like to think I did my share of big thinking. Well, not BIG thinking, but certainly nuanced, certainly multi-dimensional, characterized by a superior plasticity capable of applied abstraction,  theoretical awe, and the synthesis of five or six simultaneous subtexts with their oppositional intersections.

Things got more complicated (but not more complex) and more simplistic following my election by acclamation to the club’s presidency two years ago. Now, when it comes to Truth, I spend most of my time on the intellectual equivalent of a middle school playground.   Over and over, I tell the same simple story of an outrageous bluff pulled off by a powerful media elite for the specific purpose of permanently discrediting me. Over and over I point out the swift efficiency with which a handful of people achieved immediate and unquestioned national media compliance. Over and over I explain that this shows an already entrenched and systemic corruption far worse than the  American public imagines.
 I’m neither believed nor told why. The narrative itself bores me to the brink of shutting down my brain, while remaining inexplicably exhausting. At times I can actually feel my brain shrink as I brace myself to repeat a basic point to someone who already understands it perfectly.

MY INTELLECTUAL ARENA

Some say that I’ve developed into one of those obsessed fans, the kind whose loyalty and dedication devolves into a variation of obstructive stalking that all celebrities dread.
 Although my time on the playground may have produced a certain degree of myopia in my perception, I don’t see it, myself.

I JUST KNOW TRUTH IS AROUND HERE SOMEWHERE. WHY DOESN’T ANYONE NOTICE WHEN IT DISAPPEARS??

The fact is, I haven’t stalked Truth so much as tried to keep track of it. Frankly, I’d had no idea that it was so absent-minded, nor so anonymous and scruffy: I wouldn’t be at all surprised if Truth wandered off unnoticed someday and forgot to return. I’ll admit that I do tend to hover a bit; however, I strongly deny all rumors of that electronic tracking device trending on Twitter last month.

 My critics, like most people, are completely unaware of the responsibilities of a national fan club president. Lord knows the job is a thankless task: just ask the presidents of the Ayn Rand, Vanilla Ice, and Door to Door Encyclopedia Salesmen fan clubs.

 For example, at our club’s last national convention, I had to break up fist fights over jazz fusion, the gold standard, and the Chicago Cubs, then kick out the usual spies from the ACLU, and ban as frivolous the introduction of a resolution that “Truth is beauty, beauty truth, etc”.

On top of that, I spent half the convention dealing with the Christian delegates alone: first, I barred them as a body until they submitted a group statement admitting Christianity’s historic proximity to, and familiarity with, Islāmic doctrine and culture – dating from the latter’s earliest emergence 600 years after that of Christianity’s.
I also suspended the club’s Protestant fundamentalists until they could describe the Reformation’s role in 19th century American radical abolitionism.

 By this time, all the anarchists, hip-hop artists, Palestinian children, Mississippi River tug boat crews and insane poets had left the building. As I watched them leave from an upper window, my heart filled with love, and then sank. I was left to deal, ungraciously, with a squabble between several prominent physicists and a group of Staten Island ninth graders.
The teenagers’ claim to have located the planet Krypton within a parallel universe met with vehement opposition by the scientists, who insisted that Krypton is actually located in our own galaxy.

Anyway, I didn’t want Truth to lose its morale, which is why the paparazzi caught me trying to poke a housewarming gift of homemade brownies through Truth’s living room window recently. I was only trying to cheer it up.
Instead, Truth served me with another restraining order. Just my luck – only two months after the last one expired. I mean, jeesh! Who knew that climbing seven little stories would get people so worked up?

I saw that he had tears in his eyes and looked around somewhat desperately for Truth. It met my eyes through the thick window glass and shrugged hopelessly.
 Then Truth closed the curtains.

You know, frankly, I think Truth tends to over-react. The respective presidents of the Justice, Wisdom, and Beauty fan clubs all say it should appreciate a fan club president like me.
“You won’t catch us baking brownies for the old goats,” they said.

“I am,” replied the Justice Fan Cub president, a nice man named Fred.  “In fact, that was my campaign slogan: ‘Justice is an old goat’ “.

I stared at Fred as he told me that his club had done a lot of housecleaning.
“The first thing we did was kick out all the nonprofits who work for justice. We banned Progressives who couldn’t define that political identity with more precision, the Peace Corps, and any group that published photos of villagers gathered around drinking wells it had funded” he said.”That was a good start. Then we elected a big slate of new officers: fast food workers, Honduran children, prostitutes, Zapatistas,  mental patients, West Virginia coal miners, junkies, teenage gangsters, convicts and welfare mothers. Things have really been looking up for us ever since.”

 West Virginia’s coal miners survived by laboring to destroy both the mountains they love (see below) and their own bodies. Now used up by the coal companies just like other commodities, they are left to die of Black Lung Disease, with no income and no possibility of employment, surrounded by the corpses of mountains that provided generations with abundant game, fish, medicinal plants, and firewood.

A former coal miner from the town of Appalachia, West Virginia, is the new national treasurer of the Justice Fan Club. He is planning a class action suit against the Empire Coal Company and has organized a fiddle manufacturing collective.

IT ALL STARTED IN THE FORD COUNTY JAIL

Less than a week after I wrote this story, I was subpeonead by the Ford County DA to reveal the name of the confidential source mentioned. It was the beginning of a nightmare for both Sam Bonilla and myself. More to come on Electrica in the Desert.  NOTE: The photo above is of the old Fort Dodge Jail just outside of the Dodge City limits. It was constructed as part of the federal military campaign to subdue the Native peoples in Kansas after the Civil War. It’s not the jail in which Bonilla was incarcerated a few miles away, but I included it because, for me, it symbolizes an ongoing mentality that characterizes the forces that continue to operate in southwestern Kansas.

DOUBLE DARES, DIRTY TRICKS, AND SUCKER PUNCHES: GATEHOUSE MEDIA GOT LOST AT THE RODEO

 

 In what would have been a jaw-dropping display of sheer chutzpah were it not for a surprise gift of immunity from a prominent non-profit two years ago, GateHouse Media chief counsel Polly Sack supplied a sophisticated, global audience with the clearest evidence of simple textbook libel that most reporters will  ever see.

The third of three documents that, together, constitute nothing short of proof,  Sack’s 2010 letter to the New Yorker Magazine also adds the surreal quality of what appear to be  unescessary lies:  GateHouse, which owns about 400 small-to-midsize newspapers and shoppers had essentially been handed immunity by former Reporter’s Committee for a Free Press director Lucy Dalglish, now dean of the U. of Maryland’s J-School.

The GateHouse Get-Out-of Bar-Sanctions-Free Card is Dalglish’s  Feb. 10 statement to the AP, a very deliberate fabrication that denies my truthful description of the corporation’s attempts to force me to name a confidential source under oath. Dalglish’s status and influence easily trumped my word, getting GateHouse off the hook with the mainstream media and all but a few blogs, only one of which was national.

One wonders why Sack would risk another easily proven lie, given such carte blanc insurance by Dalglish. Either she was concerned about the remaining trail of evidence carelessly littered by GateHouse executives, attorneys, publishers, and editors – or the confidence engendered by an unexpected and formidable ally like the RCFP went to her head.

The first of the three documents listed above is a sharply worded GateHouse rebuttal of my Feb. 10 statement to the Associated Press,  in which I alleged that Gatehouse had attempted to force me to reveal a confidential source by refusing to provide  me with legal counsel if I didn’t comply with Ford County (Kansas) District Attorney Terry Malone. The corporation insisted that it had provided me with free, independent, confidential counsel from the beginning of the case through its conclusion.

This complete fabrication is a testament to the growing strength of a chillingly cozy relationship between national First Amendment/Free Press advocates and corporate media, controlling multiple platforms.

The second is the weak-kneed but nevertheless clear acknowledgement of the truthfulness of my claims, written by Dalglish almost two and a half months after she’d publically disputed them, following a conference call with myself and Legal Times reporter Tony Mauro.  The latter was then the president of the steering committee of the non-profit that employed Dalglish for over a decade, the Reporter’s Committee for Freedom of the Press.
Astonishingly, the New Yorker story ran 20 days AFTER Dalglish had already clarified  the facts as I’d presented them . True, her ambivalent tone and  extraordinary choice of “public” placement  re. her statement raise many questions – she hid it in the RCFP archives, rather than send it out as a press release, and about seven months later all references to my case that could prove damaging to Lucy had disappeared. (Fortunately, I have sufficient documentation without them).  Nevertheless, powerhouse corporate attorney Sack’s disregard of a public, signed statement  is very significant. It indicates either a status quo, which means that one night a couple of years ago, our free press disappeared out the back gate. Or if such flagrant contempt is not the norm, what factors engendered this extraordinary abuse of power, and allowed it to be employed with such lethal and unremitting force against a lone reporter for a small daily with a geographically remote readership?  Is the failure of my peers to speak out as significant as it appears to me to be?

Finally, how the hell did one person – regardless of ability and character attain a level of power over a press like America‘s?  Sure, it has to watched like a hawk,  and sometimes (okay, too often) the press needs a good kick.  Still, I’ve always thought we  averaged out to do a pretty good, even decent job for the people we’re supposed to serve.

Evidently not.
Evidently, the biggest censor of the press is the press itself.

A letter in response to Calvin Trillin’s article (May 10, 2010)

Calvin Trillin offers a probing examination of the complex network of social forces surrounding a shooting death in Dodge City (“Incident in Dodge City,” May 10th). Our former reporter Claire O’Brien played an important role in his story, and the subpoena issued to her allowed GateHouse Media to vigorously defend its belief in the principle that journalists should not be conscripted into the criminal-justice system as witnesses based on legitimate news gathering. After the Kansas Supreme Court declined to determine the reporter’s privilege issue and refused to grant a stay of O’Brien’s compulsory testimony, O’Brien was repeatedly advised that it was her decision alone whether to testify. However, we did cover the costs of her lawyer—whom you identify as “volunteer”—throughout the process. And although O’Brien’s employment with GateHouse Media was terminated, the termination was for reasons wholly unrelated to the fight over the subpoena or related issues.

Reporter Who Exposed Racism Finds Herself Jobless

“It’s been a little over a month since Sam Bonilla, a Mexican immigrant opted not to go to trial in Dodge City, Kansas for killing a local man during a situation he claims was self-defense,” Marisa Trevino wrote Friday on her Latina Lista blog.

“Bonilla’s reason for not facing a jury was [reportedly] that he didn’t feel he could get a fair trial in Dodge City because he was Latino.

“Time will tell if Dodge City officials were as clueless to the racial tensions that exist in their town, as they claim, or they just didn’t like anyone pulling off the blanket and exposing how they always did things.

“No matter which way it’s looked at, the situation in Dodge City needed to be exposed. If it had not been for Claire O’Brien, the reporter for the Dodge City Daily Globe at the time, no one would have found out about Bonilla or Dodge City.

“. . . But not everybody was happy that O’Brien exposed Dodge’s racial undercurrents. In a bizarre show of unprofessionalism, the presiding judge in Sam Bonilla’s sentencing hearing, Judge Daniel Love, took over 10 minutes to publicly berate O’Brien, who was present in the courtroom, for stirring things up in town. He blamed her choice of words in her reporting to describe Bonilla’s situation. By the time the judge was done, it was clear he viewed O’Brien as a troublemaker ‚Äî yet, everyone else should have seen her as doing her job, and doing it well.

“However, in the hours after Bonilla’s sentencing, O’Brien found herself in a situation that no reporter should be in for doing their job. Within a span of hours, O’Brien lost her job at the Daily Globe, was uninvited to speak at a journalism conference, was ignored by the Kansas Press Association in her role for finally getting the Shield Law passed in Kansas and began a quest to redeem her journalistic reputation. . . . ”

  • ABSTRACT: ANNALS OF CRIME about the State of Kansas v. Samuel Bonilla. Last Labor Day afternoon, Tanner Brunson—accompanied by his friend Steven Holt, Holt’s daughter, his stepson, and a former boyfriend of his stepdaughter’s—drove his truck down a riverbed in Dodge City, Kansas. Holt and Brunson had consumed a lot of beer and in the riverbed they came upon Sam Bonilla, a Cox Communications cable guy, walking with his older son and his nephew. As Brunson’s truck approached, Bonilla gave him the finger. Holt and Brunson got out of the truck and as they approached Bonilla he fired on them with a .22-calibre gun. At the hospital, doctors stabilized Brunson, but Steven Holt died. Both Holt and Brunson were “good ole country boys.” Bonilla was Hispanic. Describes the history of the Hispanic community in Dodge City; almost half of the city’s current residents are Hispanic. After some hesitation, Bonilla turned himself in to the police on the evening of the shooting. He told them that he repeatedly shouted “Get back!” to Brunson and Holt before shooting, a claim confirmed by Holt’s daughter and stepson. Bonilla was charged with second-degree murder in the death of Holt and second-degree attempted murder in the wounding of Brunson. Rebecca Escalante, who runs Becky’s Bail Bonds and Tax Service, has found the Hispanics in Dodge City to be considerably less assertive than what she’d been accustomed to in Texas. Bonilla worked part-time for Escalante, and on one visit to see him in jail she took along Claire O’Brien, a reporter with the Dodge City Daily Globe. O’Brien’s article about Bonilla—in which he said he didn’t think a Hispanic could get a fair trial in Ford County— caused a sensation in Dodge City. County Attorney Terry Malone subpoenaed both O’Brien and Escalante—demanding that they reveal any anonymous sources, that O’Brien hand over her notes on the jailhouse interview, and that they both testify in a closed-door proceeding. Doug Anstaett, the executive director of the Kansas Press Association, thought the case made a good argument for the Kansas legislature to pass a shield law to protect reporters. Attorney Lucille Douglass, who began representing Bonilla, claimed that information about weapons and anti-Hispanic sentiment could have been easily obtained by subpoenaing Brunson’s MySpace page. A blog in Texas, Latina Lista, described Dodge City as “a place where some of the ‘white’ locals like to play a game they call ‘Border Patrol’ where they use their trucks to intimidate Latino pedestrians.” The implication was that Bonilla was nearly run over because he is Hispanic. Mentions gun rights. In early March, it was announced that Bonilla accepted a plea bargain on the reduced charges of voluntary manslaughter and aggravated battery, resulting in a sentence of seventy-four months. As a noncitizen who had committed a felony, he would presumably be deported after completing his sentence.

A friend suddenly exclaimed in a small discussion, or rather a small talk one evening. I was startled, and thoughtfully and settling the sad news.

At first we were just talking about complaints unvaried; surrounding the absence of state (leader) in a variety of problems. But the conversation seemed to lead to more serious. Those who are activists, scholars, and various other designations, such as has reached the desperation stage. Desperate for a variety of ways have been submitted to the government, the representatives of the people, the rulers, on a number of domestic problems. Desperate as they are free demonstrations, free shouted protest about something wrong, about something that is required to be fixed by the entire elite of the country, but freedom of speech is like an end in vain, not heard. Or Heard but ignored.

Another friend exclaimed: “in the New Order era, our mouths are silenced, but the voice (said) we can be very sharp, up to their ears ripped off (ruler). Released but now we speak, we are not silenced, but they covered their ears, to sound we were helpless. “

I was immediately reminded of a piece of poetry opposition activist 98, who because of the sentence in his poem that echoes the reform movement and make it real.

The power of that poem: “… there is only one word, Fight!” makes the poet cum activist Wiji, becoming one of the abductees who have not been found until now. But the seeds of reformation through the encouragement of co-writing the words in the poem that has reaped the results now.

When the pen can still be a weapon, the power can still be controlled, but what happens when the pen (words) can freely voice but becomes meaningless in the ear? Just become ignored? Then the words, has actually died. The words had been pent cold, mute on tomb.

Yudi Latif, in “sowing national character” (2008) referred to “any revival movement started from the sign., And language (words) is the sign.” This shows the importance of the words, in any revival movement. Starting from the conscious to speak, realized in literacy, access towards a better change is wide open.

In a word, there must be an idea / thought. Because the truth is, in the words Radhar Panca Dahana, words are clothes of all thoughts / ideas. “Words and thoughts like a paper, one can not cut one side, without cutting the other side at the same time” said Ferdinand de Saussure.

What you see below is tampered evidence: a false record fabricated by a powerful public interest attorney for the purpose of concealing her own gross violations of civil law, as well as of the ethical standards formally imposed by her profession.
This wasn’t written on Feb. 10, 2010 – not even close. It was written roughly seven months later, replacing the original post, deleting a long and contentious thread of comments, and completely obscuring the crucial facts.  It omits the central role the RCFP played in the case by never even mentioning it was an RCFP case.

Kansas reporter Claire O’Brien has been held in contempt of court and fined $1,000 after not appearing in court this morning to testify, the Topeka Capital-Journal reported.

She had previously been ordered by a Ford County court to testify about a confidential source and a jailhouse interview with a murder suspect in a grand jury proceeding. In that proceeding, she unsuccessfully argued that she was protected by a reporter’s privilege. Currently, there is no shield law in Kansas.

After the high court granted a stay in that matter, she was served with another subpoena to appear at the actual criminal trial. O’Brien’s newspaper, the Dodge City Globe filed an appeal in the state supreme court and lost.

O’Brien is seeking her own representation to continue to fight the case, the Capital-Journal reported.

The last sentence is, in fact, a bald faced lie. On the date in question, Former Executive RCFP Director Lucy Dalglish had just (and finally!) hired Kansas attorney and lecturer at KU’s J School, Mark Johnson to represent the completely out-gunned reporter.
Three months of unaided persistence later, O’Brien was able to force a conference call with Dalglish in which the latter admitted verbally in the (phone) presence of then-RCLP steering committee prez Tony Mauro that she had lied about reporter O’Brien.
Dalglish admitted that GateHouse Media attorneys had told her that the corporation would indeed cease all legal assistance to O’Brien if the latter refused to identify a confidential source to the state.  Dalglish admitted lying to O’Brien, who had first alerted her to this unprecedented corporate PUBLIC decision. Dalglish then lied to the Associated Press and to the Topeka Capitol Times, when she claimed that O’Brien had “had free and unencumbered legal assistance the whole time and has evidently chosen not to avail herself of it.”
At that time (April 21, 2010) Dalglish, cursing and yelling, agreed to release a statement intended to restore O’Brien’s professional good name. What this consisted of was a comment in the RCFP’s archives, posted back in February  (remember, this was now the end of April) way near the bottem of around 20 other comments! It wasn’t even a post of its own.
Fortunately, Dalgish also sought to put out the flames on her good friend, the Society of Professional Journalist’s site, so she posted an identical statement on its FOI blog. Both of these her statements disappeared, but I was able to get a screen shot of the FOI blog copy.
Please stay tuned for more of the truth – before the interests that prop up the powerful destroy and silence a good and honest reporter forever.

To Whom it May Concern:

This memo is to clarify misperceptions regarding the circumstances surrounding Claire O’Brien’s refusal to appear before a Kansas inquisition on February 10, 2010.

Ms. O’Brien was subpoenaed to testify in Dodge City, KS, in a murder investigation. She had written a story in the Dodge City Daily Globe regarding an October 13 jailhouse interview that also included statement from an anonymous source.

O’Brien’s then-employer, GateHouse Media, had unsuccessfully fought the subpoena all the way to the Kansas Supreme Court.

It was my understanding from talking to a GateHouse representative before the scheduled testimony that the company had told Ms. O’Brien that it would provide an attorney for her at the Feb. 10 proceeding, but that if she refused to testify regarding her anonymous source, its financial support for her legal representation and subsequent potential fines would end.
